Terms and conditions of sale

1. Purpose
These terms and conditions of sale (the "Terms") govern the sale of the UNYWAYS subscription, an online running coaching service available at unyways.com. They apply to every subscription, to the exclusion of any other terms.
They are made available to the customer before subscribing; confirming the order constitutes unreserved acceptance.
2. Identity of the provider
Name: Joachim BERLAND
Address: 99 Traverse du Val Fleuri, 06250 Mougins, France
SIREN: 938 888 039
Email: contact@unyways.com
3. Description of the service
For as long as it runs, the UNYWAYS subscription gives access to:
- a personalised training programme, built from the questionnaire completed by the customer (level, goal, availability, history) and adjusted by the coach;
- a personal member area for viewing sessions, submitting feedback after each session and completing a daily readiness check;
- importing GPX race files and analysing them (distance, pace, splits, elevation and heart rate where the file contains them);
- leagues between runners, with a monthly table and challenges;
- written exchanges with the coach from within the member area.
The service is provided remotely. It includes no in-person sessions, unless separately agreed in writing.
The coach releases training weeks as the customer progresses, rather than the whole plan on subscription: that staged release is part of the method.
4. Customer account
Subscribing creates a personal account protected by a password. The customer is responsible for keeping their credentials confidential and for all activity carried out from their account. Account sharing is prohibited.
The customer undertakes to provide accurate information, particularly in the training questionnaire: the suitability and safety of the programme depend directly on it.
5. Price
Current prices, inclusive of all taxes, are as follows:
| Plan | Price incl. tax | Billing |
|---|---|---|
| Monthly | 14,99 € | Every month |
| Yearly | 149,99 € | Once a year (two months free) |
VAT not applicable, Article 293 B of the French Tax Code — the provider falls under the small-business VAT exemption. The prices shown are net; no VAT is charged and none is recoverable.
Prices may be changed at any time for new subscriptions. For an existing subscription, any price change is notified by email at least thirty (30) days before it takes effect; the customer remains free to cancel before the next renewal date.
6. Ordering and payment
Subscription takes place online. Payment is processed by Stripe Payments Europe, Ltd., an authorised payment services provider. The customer's card details are entered directly into Stripe's secure interface: they do not pass through UNYWAYS servers and are never stored there.
The subscription is paid in advance and charged automatically at each renewal date, to the payment method on file. The contract is formed once payment is confirmed; a confirmation is then sent by email.
If a payment fails, access to paid features may be suspended after an unanswered reminder, until the situation is resolved.
7. Term, renewal and cancellation
The subscription runs for the term of the chosen plan (one month or one year) and renews automatically for the same term unless cancelled.
The customer may cancel at any time, without giving a reason and at no cost, from their member area (under "My subscription") or by writing to contact@unyways.com. Cancellation takes effect at the end of the period already paid for: access is retained until that date, and no further payment is taken thereafter.
Under Article L215-1 of the French Consumer Code, the customer is informed by email — no earlier than three months and no later than one month before the deadline for declining renewal — of their right not to renew the subscription.
The publisher may terminate a subscription in the event of a serious breach of these Terms by the customer (account sharing, reselling programmes, abusive language towards the coach), after a formal notice has gone unanswered. Sums corresponding to the unused period are then refunded pro rata.
8. Right of withdrawal
A consumer customer has fourteen (14) days from the conclusion of the contract to withdraw, without giving a reason and without penalty (Article L221-18 of the French Consumer Code).
To exercise this right, simply write to contact@unyways.com before the deadline expires, stating unambiguously the intention to withdraw. The model form below may be used, but is not compulsory. Refunds are made within fourteen days of receiving the request, using the same payment method as the original order.
Immediate start and waiver. The service is supplied remotely. If the customer expressly requests that their programme be delivered before the fourteen-day period ends, they are informed that they will owe an amount proportionate to the service already provided should they subsequently withdraw (Article L221-25 of the French Consumer Code).
This request for an immediate start, and the acknowledgement of its consequences, are collected explicitly at the time of subscription — they are never presumed.

9. Customer health and safety
The service provides athletic training. It is not a diagnosis, a treatment or medical advice, and is in no way a substitute for consulting a healthcare professional.
The customer declares that they are fit to run and undertakes to consult a doctor before starting, particularly in the case of any cardiovascular history, injury, pregnancy, ongoing medical treatment, or a return to running after a long break.
The customer must stop any session in the event of unusual pain, faintness or abnormal breathlessness, and inform their coach. The programme is a framework; it can always be adapted, and no session should ever be completed at the expense of health.
10. Customer obligations
- Provide truthful information in the questionnaire and in readiness checks.
- Use the service for personal use only.
- Not reproduce, resell or distribute the programmes and content supplied.
- Not attempt to access parts of the service not intended for them, nor to disrupt its operation.
11. Service availability
The publisher endeavours to keep the service continuously available but cannot guarantee uninterrupted access: maintenance, updates or incidents affecting technical providers may cause temporary outages. Where an outage is planned, it is announced in advance so far as possible.
In the event of a prolonged outage attributable to the publisher, the customer may request a goodwill adjustment pro rata to the period concerned.
12. Liability
The publisher owes a duty of care rather than a duty to achieve a result: he undertakes to build and follow up the programme with the rigour his qualification demands, but cannot guarantee that any specific performance will be reached, since that depends on factors outside his control (consistency, sleep, nutrition, health, race conditions).
The publisher cannot be held liable for harm resulting from inaccurate information supplied by the customer, from failure to follow the programme's instructions, or from continuing to exert oneself despite pain or contrary medical advice.
Nothing in these Terms limits the rights the consumer holds under the law, in particular the statutory guarantee of conformity.
13. Personal data
Data collected in connection with the subscription is processed in accordance with the privacy policy, which details the purposes, retention periods, processors involved and how to exercise your rights.
14. Consumer mediation
In the event of a dispute, the customer must first send a written complaint to contact@unyways.com, with a view to reaching an amicable solution.
Under the provisions of the French Consumer Code on consumer dispute mediation, having contacted us and failing a satisfactory reply, you may refer the matter free of charge to a consumer mediation procedure with:
CM2C
49 rue de Ponthieu
75008 Paris, France
Telephone: +33 1 89 47 00 14
Report a dispute: www.cm2c.net/declarer-un-litige.php
Email: litiges@cm2c.net
Mediation is a consumer right: it does not remove the option of going to court afterwards. A referral is admissible only if a written complaint has first been sent to the publisher, and within one year of that complaint.
For information: the European Online Dispute Resolution (ODR) platform permanently ceased operating on 20 July 2025, Regulation (EU) No 524/2013 having been repealed by Regulation (EU) 2024/3228. It is therefore no longer a route of redress and no longer needs to be referenced.
15. Changes to these Terms
These Terms may be amended. The version applicable to an order is the one in force on the date of that order. Any material change affecting an existing subscription is notified by email before it takes effect, the customer remaining free to cancel.
16. Governing law and jurisdiction
These Terms are governed by French law. Failing amicable or mediated resolution, the dispute falls to the competent courts. The consumer may bring proceedings, at their choice, before the court for the place where they resided when the contract was concluded or where the harmful event occurred (Article R631-3 of the French Consumer Code).
